VOLUMINOUSNESS

It is by the wanton and deplorable waste of Paper committed made by all Legislation, much more so
than from the nature of the work the very nature of the subject itself, that a Digest of any of the Law is found to be
voluminous a work:— What need for instance in a work <add>too which professes to be a compound</add> to prove be only of Homer with
Justinian that the Swine Pig is a gregarious animal by a passage from Homer which does
prove it after all? proves no such thing as if that absolute Emperor had it not otherwisein his power Willing to establish
the doctrine proposition which he inferred from it's so being, had it not otherwise in his power

... Now it was no more than the fashion
for Hog-drivers to read Homer
in Rome than</unclear> but this were indeed in
Constantinople than it is now and England

I make instance of this truth,
as being celebrated for its conciseness,
to shew how much further
that property might be carried
if all superfluities were to
be [rigorously] lopped off.

What need for the preposterous modesty of the word "indeter" recurring in every page
a mode of language as inconsistent to with that precision which is the most indispensable of the formal qualities first quality property <add> month</add> of a Law or worth thing
majority of the Sovereign power: which betrays from under Imperial marble the name of the Sovereignty
the dispensations & indeterminate</unclear> irresolute diffidence of the compositor commentator, like the chemothestic features of the ignobler animal pushing projecting through ill-cover'd by the Lion's .

More than half perhaps that work short small as it is will be found to be taken up by the
frivolous disputations spun out sometimes to the length of 1/2 a page to have understand after all what
the two words would have determined either way with equal utility.||

|| Note
This practice seems to have proceeded had its
origin in good measure, from the notion law is more conformable
that no alteration must on exclusion
of the other conformity to the confused Idea of
Natural Justice, whose dictates therefore
it was the business to find out
whereas by far the greater share of
ability accrued not from the produ but from the establishment of either.

For of disputation there is
and neither is nor is any thing easier than for one man standing in the station of a pleader to
employ a volume upon a question, which another invested with due authority shall decide with perfect
one or two two or three times.

And to this, if I may be permitted
to mention the mask a little sort of its place
is among the monstrous voluminousness
of our Common Law; which consists of comparatively but a few axiomatical
propositions</unclear>, floating in an <unclear>immense Sea of controversy.

I insist not upon the Legislative stile of the effects of a more modern and equally
race, who not content to "disdain" without they who "statute & command" are made to talk in a language which often describes as much from
him concordant lines of {simplicity proponents}
of his Majesty from Majesty
whom utility would either way have
followed the decision
when a decision when permanent &
praenotified will either way be followed
by Justice & by Utility
by a loquacious rampant / haughtiness as that of the Roman Emperor
by a creeping Irresolution.
<p>There examples will suffice
to illustrate the aphorism That "The Laws should command J not ad argue dispute" of the

Bacon who to all the majesty of genius and examplified in that invaluable
collectiopn of Jurisprudence maxims Aphorisms of which
there is one
, adds more of the precision of Ju
intermuted judgement exporance than his age could reasonalby have hoped to see, and is more truely
perhaps than the Grecian Critic of whom it was first applied " himself the image an example of the great sotlaine he
draws."

So distant from true dignity,
from eligance precision
