C 3.

Of Unlawful Reproach

places, terms, and other circumstances: it bears more strongly the
character of reproach vituperation when it is couched in single words, as villain,
lyar, coward.

6 Reproach more concise. visiting persons, places, times &c Single terms which are the expressions that serve most
strongly to express reproach, vituperation will not serve most strongly to
express defamation: for single terms will not express those
circumstances of person, place, and time, which are necessary
to place in the fullest point of view the apparent truth
of the charge contained in the defamation.

7 Defamation is the most apt to be susceptible of proof. Ex. gr. lyar drunkard & glutton, more defamatory to miser, misanthrope hypocrite more vituperative The more easily a quality with which a man is charged
in the way of defamation is capable of being detected by
single and determinate Acts capable of strict proof, the more
strongly any single epithet by which he is charged with that
quality partakes of the nature of defamation. Thus the epithets
of lyar and drunkard and glutton, partake more
strongly of the nature of defamation, than the epithets of
Miser, Misanthrope or Hypocrite.

Defamation behind back in absence is worse than in presence. Defamation with or without reproach vituperation is apt to be
more mischievous when delivered behind a man's back than before
