Of Unlawful Threats Menacement.
N.B. 15 Aug. 1810. Menacement , if simple, belongs to Offences against the Person, Simple Personal
injuries : if conplete with insult to Offences against person and
reputation
Unlawful Threats defined. An 'Unlawful Threat Menacement is where a man is
intentionally (A) concerned (B) in giving You reason to
apprehend (C) that by his means some injury (D) will
be done to You.
Exposition. 1
[(A) Intentionally] That is when his intention is, not
only to do such acts as eventually prove the means of terrifying you , act in such or such a manner, but to produce
that very effect.

[(C) Reason to apprehend] 1. It matters not in
what way the threat is expressed No matter by what means. ; whether for instance in language as by speaking writing or
printing ; or by gestures ; or by emblematical or
imitative representations ; as by saying that You
will beat him , or shaking your fist at him: or
presenting a pistol at him ; or drawing his portrait
hanging, intimating withal that through your
means, such will be his fate.

It matters not whether the Threat be addressed to
the very person threatned or to any third person Nor whether addressed to the party.

It matters not whether the Threat be uttered nor whether in his in the
