Offences against the external Security of the State.

Piracy can scarcely be deemed a distinct species of offence :
for theft and robbery upon the Sea are just like
Theft and Robbery upon Land. There is the same reason for
punishing them when committed upon the Sea as when committed
upon the Land ; and there seems to be no other. There
is reason for punishing with as much severity in the former
case as in the latter, but there seems to be no reason
for punishing with more . In general indeed, if the quantity
of the punishment be adjusted to the mischief of the offence,
the punishment for piracies will in most instances prove
greater than the punishment for theft and robbery : but
this is only because the offence is committed in a greater
scale; let the damage done be the same the punishment will
be as much in the one case as in the other.
But though the principal offence in the two cases
is much the same , yet the accessory offences will admit of
a description somewhat different. On this account it may be
proper to make a distinct head of the offence of Piracy. (a) The
