C 21. Offences against the external Security of the State.

Upon the whole then it appears that offences which
endanger the external security of one's own state may
be distinguished in the place into such as are acts of
hostility to that very state and such as by being acts of hostility

they are commonly called the Pizatical States. With the British
state they are commonly not at war. With this state they
are engaged in treaties which bind them to spare all vessels
of that nation: and to obviate doubts that may be
entertained whether such or such a vessel be of that nation
or no they engage to spare all vessels that come proceeded
with passes of a certain form granted by the British
admiralty. These passes, British subjects, in order to save
the expence of genuine ones or in order to sell the counterfeit
ones to the subjects of other states might be
disposed to forge: which practice would give double
strength to the doubts and disputes which the passes were
designed to obviate, and (besides the prejudice which might
thence ensue to the individual traders who were possessed
of genuine ones) might if connived at by the government
involve the nation in a war with the states to whose prejudice
such a fraud might operate. These reasons are explicitly
declared in the British Statute , + + 4. Geo.II. C.18. 1731. whereby such a forgery it is accordingly made a capital offence.
