safe-conduct is violated, or an Ambassador consulted
to forbid the Court of Justice from proceeding to
judgment till after having consulted the Sovereign,
& even to reserve to the Sovereign the power of
punishing the delinquent in an extraordinary manner at discretion, & even of
of giving him up this malefactor delinquent to the power
of the offended state. [a]
All this is not perfectly exact: but the exactness
of it depends so much upon the infinitely diversified
connections of particular states one with another,
that it would be to no purpose to attempt to make it
so.

In absolute Monarchies such as France & Spain
such power can not be wanting: but there may be a
want of it in such states or confederacies of states
in which the judicial power is not subordinate independent of the power
of making war and peace, as for instance in the Dutch provinces,
the Helvetic body, & in England. & till of late in Sweden.
