Of Smuggling

Non payment of taxes is either fraudulent
or not fraudulent. It may be termed fraudulent
when accompanied either with endeavors
either to conceal the fact of a man's being in any of
the circumstances in which he is required to pay, payment is required
or to withdraw himself or his his person or effects from being
amenable for the omission. It may be termed
not fraudulent, when not accompanied with either
of those endeavours.

The Non payment of taxes accompanied
by endeavors [either] to conceal the fact of the a
man's being in any of the circumstances in which
payment [in the case in question] is required,
[or to withdraw his person or effects from being
amenable for the omission] is what generally
goes by the name of Smuggling.

Smuggling by this account of it appears
to stand plainly on the footing of a fraud: or
or what comes to the same thing if Embezzlement
is the Definition of Theft, Fraudulent obtainment
and Embezzlement
