Prodigality

The only case in which any immediate measures can be taken for restraining prodigality is that of a
man who lives upon his income. When a certain
proportion of his fortune has been spent, in order
to save him from want, the remainder at the instance of his friends
might be subjected to sequestration. Such a provision an expedient
when carried into effect execution would operate as a
remedy and in the mean time it would operate in prospect [the prospect of it
would operate] as a punishment.

Among the Germans there was a provision for that
purpose. In England persons are sometimes forced into to enga enter into engagements of the for such
a purpose by the importunity of their creditors.

To enter into the details of a plan of this sort
comes not within the design of a criminal code. It
will be sufficient in this place to exhibit a few
outlines. The detail of the provisions relative to such a
design would come under a division that might be
entitled Laws concerning Prodigals.

1. A plan of this sort should not operate to prevent
the conversion of one species of property into another
for instance the sale of lands. Laws preventing the alienation
of landed property or known to be

not upon sale but upon expenditure.

2. Care should be taken that all persons who are in a
situation to be interested either on their own account
or that of the prodigal in the preservation of his fortune
have the option of employing this remedy one after another according to
the amount nearness of their respective interests.
