3. Care should be taken to prevent a mans being
harrassed upon every slight trivial occasion. A certain
quantity of waste should have been actually committed within a
certain time in order to warrant an application
of this kind. In this view two circumstances are to be
regarded. 1st the proportion of the waste. 2d the rapidity
with which it has been committed.
4. Care should be taken by proper limitations to
prevent save such estates from this enquiry as would
not bear the p expence of it.
5. The Prodigal from the time of sentence past might
be put upon the footing of a minor with respect
to his disability of charging himself except for necessaries
suitable to his degree. And that persons may be
aware of him, his name may be enter'd upon a
register, the contents of which should from time to time
be published. The shame of being thus exposed would
be a powerful restraint.
6. After a certain number of years to be limited
by the Judge, the estate should be restored; or before
if it clears itself before.
7. To the Judge it would belong to determine from
considering the nature and degree of the prodigality
whether the estate should be restored before it had
cleared itself, and whether any estate that might
devolve upon him subsequently should be applied & in what
proportion to accelerate the clearance.
