1 C Abuse of Trust.
Abuse of Trust, how understood here Abuse of trust [as here understood] is where
a Trustee takes advantage of the power given
him by the trust in order to do an injury
to a person party other than the benefitee.
Why it is not consider'd as including breach of trust. Abuse of trust in the ordinary acceptation
of the phrase would probably be understood to extend
to the benefitee as well as to any other party:
it would accordingly be understood to include breach
of trust. Breach of trust however would not it
should seem be deemed understood to extend to
a prejudice done to any party other than
the benefitee: so that in common acceptation every
breach of trust is an abuse; but not every
abuse of trust, a breach. But the two cases viz:
where the party prejudiced is, and where he is not
the benefitee, are not only are very distinguishable in themselves,
but make a considerable difference in the nature
of the offence. It will be necessary therefore to
have different names to characterize them by:
and as the name expression where breach of trust is sufficient
for the one, it will be proper therefore to confine
the expression abuse of trust exclusively to
the other.
