Abuse of Trust
state, there are no special benefitees unless in
time of war, the persons more particularly exposed on any particular occasion to the inroads of the enemy: an injury
done by a commander under power of his authority on such an occasion to
such persons, or at other another time on any occasion to any
persons at large, [+] [+] such an instance of misbehaviour, might, (as well as the giving up or betraying or unwarrantably surrendering his force to the enemy) be termed would be an abuse a breach of trust the: an
injury done to any of the persons under his command,
would be an abuse of it.
Rule for that purpose. Upon the whole it may be laid down as
a general rule concerning public trusts that whenever any particular
persons can be seen to be more particularly in
a way than others in a way to be benefited
from the due discharge of it, and under fair an offence under
favour of the power accompanying the trust
an offence is committed to the prejudice of such
persons, the offence is a breach of the trust: and
on the other hand, whenever any particular persons
can be seen to be in a more particular manner than
others dependent upon the trustee in virtue of the
same powers, and an offence under favour of
those powers is committed in prejudice of such
persons, the offence is an abuse of trust.
