2 National Interest
will be agreeable to one man and disagreeable to another,
the same office which appears to contain impart
nothing but burthen or more burthen than profit to one man may appear to
impart nothing but profit or more profit than
burthen to another. The same office accordingly which is
an object of ambition to one man, may be an object of aversion
to another.
Now the insofar as an office imparts
profit, it becomes an article object of property, and
the usurping of it is a offence; an
offence against the individual whose property
it is: in so far as it imparts duty which
may or may not be regarded as a burthen, it
is an article object of trust, and to usurp it may
if it is an offence against the public.
Again with regard to refusal —
In what case it may be a private offence as well as a public one
In as far as Whenever the refusal of an office, is
follow attended with the effect of throwing it
upon another to whom the duty of it is a
burthen it is may be a private offence, an offence
against the particular individual or individuals
on whom, in consequence of such refusal, the burthen of it is thrown.
