Refusal of Trusts
such as Masters and Preceptors, have the charge
of a man's person during his minority, may
be and considered in virtue of that charge, as
being entrusted likewise with his condition in
life, or as far as by any neglect or other mis management
of their's his parentage may be
render'd liable to uncertainty. Both condition &
in life and under all it's modifications, and
reputation may be upon particular extraordinary
occasions be consider'd as committed by the ? care
and protection of those particular classes of occasional trustees, who
under the names cor corresponding to those of
CouncillorAdvocate and Attorney, stand in a man's
place in Courts of Law. But these occasions are
not frequent enough to have made any given birth to any
particular denominations applicable to the Trustees.
All these Trusts may be consider'd as
liable by possibility to the circumstance of
a refusal. All indeed They are not indeed a all
of them equally exposed to the probability of it. With regard to Those
which concern property will generally it will be
somewhat extraordinary if they do not find somebody
who is willing to undertake them: since
where there is property to manage, there will
be wherewithal to pay for the trouble of management.
