C 3 Usurpation of Trusts
and extortion; the only remaining means except bribery by which
a trust can be criminally usurped. When not
affected by any of the above means, usurpation
of a trust is only a civil offence; and as such
belongs not to the present purpose.
Compensation — three parties who in this case may have claim to it.
In the case of usurpation of trust there
are three parties who may be in a way to have
sustained an injury; and whose interests are therefore
to be consider'd under the head of compensation.
These are, 1. the person to whom belonged
the power of conferring the trust: 2. the
rightful trustee, or that is the person to whom the trust
belonged of right: 3. the benefitee.
Punishment.
As to the punishment it is sufficiently obvious
that this must vary with the nature of
the trust itself and the of the methods by which it
was usurped: so that nothing certain particular
can be prescribed concerning it here.
