Of Offences against Property
Theft Embezzlement and Fraudulent Obtainment
Theft. Why Theft, Embezzlement, and ordinary Sharping
are all on the same footing.
Theft embezzlement Fraudulent obtainment all one
When property to acquire any value is dishonestly usurped
it matters not whether it be by Theft or embezzlement
or Fraudulent obtainment certain cases only excepted when
fraud is punished with particular severity and measures
These are Forgery coining and dealing with false weights
Reasons
It will in many instances be impossible to distinguish
whether it be a case of theft or of Embezzlement
and even when the distinction is made no reason can
be assigned why the punishment in the one case
should be different from what it is in the other. Taking is beginning
to occupy: keeping is continuing to occupy or continuing
in the intention of occupying. Securing Using is the
producing some contact between the body occupied and
some other body. here we are arrived at sensible ideas
ideas excited by assignable real entities that is at
the point at which all definitions must have an end
Unless this be the sense to be given to these words I see
not what sense can be assigned to them
