36 C Theft Embezzlement and Fraudulent obtainment
and so on But for any offence after the first the Judge
if he should think it necessary for the advancement
of Justice may appoint a certain quantity of confinement
to hard labour which shall not be thus excused
But if the commutation money for so much as is excused
is not enough to yeild a full compensation
he shall cause the deficiency to be made good out of
the public purse
Also whatever is thus collected over and above
what amount, to a full compensation shall go into
the public purse. This power it him particularly
to make use of where he suspects the offender may
be supported by a confederate
Peneitentional Imprisonment — how far it may be commuted for The Judge may also accept of commutation money
for any part of the peneitentional imprisonment he has
authority to inflict over and above the pennance for
three days a week which he shall not on any account be thus remitted —
