C Of Theft or Stealing.
Theft or Stealing defined.
Theft or Stealing is where a man is concerned (A) in
taking (B) any thing (C) that possesses a Value (D) worth regarding (E) knowing (F)
that it possesses such a Value and that he has no right (G) to be concerned
in taking it, intending to dispose (H) of it to his own purposes
and not to be amenable (I) for it to the Law.
Exposition
[(A) Concerned] See Tit. [Of Co-Offenders.]
The taking away may be with or without Removing.
[(B) Taking] It matters not in what manner he takes it; whether
he takes it and carries it away or takes it by using it as it stands.
It matters not by what means; whether by the exertion
of his own unassisted powers either of body or mind or by
the instrumentality of any other agent rational, irrational or unanimated:
if it be a dog for instance that he has taken, whether
he induced the animal to follow him by invitation, or took it
up in his arms, or, pretending it to be his own, get another
man to carry it for him, or cause another dog to drag it after
him, or led it by a halten.
The Thing might be Moveable or Immoveable.
[(C) Thing.] It matters not whether before it was taken it were
of the number of things moveable or of the number of things immoveable
