[(a) Right] 1. In some circumstances a Man has a right to take
a thing and even convert it to his own use if he finds it. See Tit. [Of things Found].
2. A man cannot be said to know that he has no right
to be concerned in taking a thing, if he has or believes he has the leave
or permission of any person who has, or whom he believes to have, a
right to give him leave to do so. For instance an owner himself, or any
Wife, Child, Parent, near Relation, Guardian, Agent, Servant, or
intimate Friend, in cases in which they appear to him to act with
permission of the owner: whether that permission be tacit
or express.
3. It matters not whose property the thing is; whether the
property of an individual, of a private company even in which he has
a share, of a public Corporation, or of the State.
