C Of Theft Or Stealing.
Exposition.[(A)Irreplaceable(a)] A thing may be be said to be irreplaceable in
its own nature when over and above its ordinary saleable or current
value, it is of those sorts of things which are likely to have a value
from attachment;xxor, a Value of Affection. Pretiumaffectionis in the Roman Law. insomuch that when lost it cannot be made good
or replaced by a thing of equal price. As a family picture, a family
pedigree, a family monument or other memorial: an unpublished
work in manuscript: trees planted for shelter, shade or prospect.
In such case an extraordinary Value may be assigned to itPunishment.
at the discretion of the Judge: and in consequence the confinement
may be extended to any length of time even so as to be perpetual.xxor even to perpetuity.

2. Where the thing taken is irreplaceable by accident.(A)
Exposition
[(A) Accident] A thing may be said to be irreplaceable by accident,
when although it is of those sorts of things which are of a marketable

new ideas demand new terms. The derivation of it is analogous to that of irretrievable,
irreparable, and several others.
