of Theft or Stealing.
Exposition.
[(A) Prosecution] That is before the first step in the prosecution
has been taken: The application for a summons to appear, + +Or a Justiciabilis venias,
maneas, redeas, or
eas or
for a warrant to apprehend,|| || Or a Justiciabilem
capias
afferas, transferas or an arrest without warrant which
ever happens first are for this purpose to be deemed respectively
the first steps in the prosecution.
[(B) Amends] What is to be deemed amends. See in Tit. of Compensation.
A man is for this purpose to be understood to have
made amends, as soon as he has begun to convey the thing meant
to be given in amends.
In such case he shall be at any rate exempted from
such part of the hard Labour as corresponds to so much of the amends
as has been actually received and from the rest of the
Punishment he shall be exempted or not according to the
discretion of the Judge. See Tit. Excus:
