4) Offences respecting the Persons of Individuals
corporal powers. Under the first of these divisons
come the 6 genera of offences first mentioned.
1. Simple Personal Injuries. 2. Disablement transitory temporary
3. Disablement perpetual. 4 - Disfigurement
transitory temporary. 5. Disfigurement perpetual. 6. Mutilation:
together with the two last mentioned Attempts
and Terrification in the case where any of the calamities
produced by the six first are the calamities in the infliction of which is threatened
or attempted. Under the offences in this division
have been comprized under the common
application of offences against personal security.
Under the second of the above divisions comes that
single genus, only which we have entitled Personal
restraints. These have been stiled offences against
personal Liberty. Those that have been intitled Offences
against Personal Security are either followed by
Death, or not. If not they are stiled simply Offences
against personal Security as before; If
they are, they are stiled Offences against Life are
made in virtue of that important circumstance, to
constitute a new genus, which we have entitled Homicide;
and they have been stiled Offences against
Life.
Of these three appellations Offences against personal
security, Offences against Life, and offences against
Liberty, the first is perhaps not perfectly exact. At first view
it would seem to extend to Life, if not to Liberty:
the two latter however seem as altogether unexceptionable.
