9) Simple Personal Injuries.

subsisting at the time. An act of punishment is an
act done after a mischief is over, in the intention
of preventing similar mischiefs in future. Now an
act the effect of which is to produce pain in the person who is the object
and nothing more cannot as such put a
stop to any mischief of which that person is the
author: for if it does it ceases to be that which
it is here supposed to be: it becomes an act of disablement.
An intention therefore to do such an act
& that alone can never be an intention to do an act of self-defence.
[It can never take propose Self-defence as it its
end] It is not done for the purpose of self-defence.
It not It is done either done for the purpose of self-restraint either of prevention
or else of self-d vengeance.

But for the mere purpose of vengeance no legislators
ought nor are they found in many instances accustomed
to [inflict pain] suffer pain to be inflicted.
Since then the inflicting simple organical pain can
be of no use but for the purpose of punishment.
There can be no reason for making such an act dispunishable
in any case but where the person is intrusted
by Law with the power of punishment.
