be termed private may also be termed domestic. From
this source Powers of Punishment may be
distinguished into 1st Private or Domestic Powers
2dly. Public Powers.
Private or Domestic Powers are such as are given
1st To a Parent over his Child.
2d To a Guardian over his Ward.
3dly To a Schoolmaster over his Scholar.
4. To a Master over his Apprentice.
5. To a Master over his hired Servant.
6. To a Master over his Bondsman.
76. To a Master over his Slave.
8. To a Husband over his Wife.
Public Powers are such as are given
1st To a Judge and his delegates over persons in general
2dly To the Keeper of a House of Correction over
the persons under his charge.
3dly To the Keeper of a House of Prison with
over the persons under his charge.
4thly To the Keeper of a Mad-house over the persons
under his charge.
5. To a Military Commander over persons under
his command.
These Powers whether possessed on a private or
on a public account must at least be communicable
to persons acting in the in consequence pursuance of
