12) Offences respecting the persons of Individuals.

To discuss the limits that consider what limits ought to be set to this
branch of the castigatory power as here in question in
the instances of the several sorts of persons to who
are invested with it, does not prope belong properly
to this place. The settling of those limits to will form part of the matter
of the several particular Codes relative to those several sorts
of persons.

Tis for that reason that it is not practicable in
this place to state the reasons why the circumstances
which serve to invest a man with the
character of the superior in any of the above relations
ought to operate with regard to the offence
here in question under consideration in the way of exemptive circumstances.
To do this would be to enter into the reasons which
the Law has for establishing such of the above
relations as are natural artificial, and for the giving legate
power to the superior party in the instance of such
of them as are natural. We must content ourselves
here with observing that if that branch
of castigatory power which consists in the right
of inflicting organical pain on the persons subject
to it be proper to be bestow'd on the party who
occupies the superior place in any of the above
relations, the fact of his occupying that place ought is of
course to be admitted to stand with respect to the offence in question as an exemptive circumstance.
