17) Simple Personal Injuries.
Circumstances proper to serve as grounds of aggravation
may be distinguished into 1st Such as affect
the description of the act. 2d Such as affect
the description of the person who is the Author object
of the Injury.
First as to such as affect the description of the
act.
1. When the effect of the act is to produce the
personal disablement of the sufferer, the offence
varies it's nature and may be characterized by
the name of Disablement.
2. When the effect of the act is to produce the
disfigurement of the sufferer, the offence again varies
it's nature and may be characterised by the
name of Disfigurement.
3. When the effect of the act is to produce the
mutilation of the sufferer, the offence again is
again varied in it's nature, and may be characterized by
the name of Disfigurement Mutilation.
4. When the effect of the act is to produce the
Death of the sufferer, the offence is again varied
in it's nature, and is known by the
name of Homicide.
In all these cases the offence still comes within
the same order of offences. It is still but one
offence against the person.
5. When the intent of the act is to deter the
sufferer from opposing a the suff offender
or an accomplice in the design of taking away
any one's person's property without colour of title.
In this case the offence takes the name of Robbery, and
