By Threats, as no act is done in the intention of
producing any painful contact or any contact between the person

N.B. The Law confounds threats with attempts:
ranking threats when expressed by gesture among
assaults. Shaking a fist at a distance it calls
an assault.
Threats open )( concealed in secret. Threats again may be distinguished into open
and anonymous. concealed. This distinction is of importance.
Threats general )( special. They may again be distinguished into general or indefinite
and special. or definite This distinction likewise is of importance.
The mischief of threats follows the nature of the
mischief of the injuries which they announce.
A threat of injuries of the ignominious kind produces
a pain of apprehension grounded on the pain of
ignominy.
Challenge — mischief of. The effect of a Challenge is if to accepted declined to produce
a pain of ignominy: if accepted, the chance of those organical
pains which it is the nature of fighting to produce
