38) Pers:l Inj:s Inserenda.
Pers. Inj. Motives must be supposed to be ascertainable. The Law which in so many such a multitude of cases
does and at all events must take upon itself to judge determine
of or men's motives and intentions, why should it not in
this?
Attempts Punishment. The Attempt When the failure is owing not to the partys
desisting; but he has done as much him lies to consummate
the injury he intended: injuries the attempt should be punished
in the same manner as the consummation, or nearly
so. For the public mischief, the [pain of] popular apprehension
is nearly the same.
Malicious prosecution a species of attempts.
A nuisance is where a personal injury
Personal Injuries may be distinguished into
fugitive and habitual.
When a Personal injuryies ensue or are supposed
likely to ensue from a cause
Nuisances. It may happen that in the train of Instruments
or that have a share in the production of a personal
injury, may be one in which the situation
by which it is fitted to concur in the production
of such injury is permanent. By this means
repeated injuries of the same kind are continually
produced, or in danger of being produced. When
this is the case such injury is stiled a Nuisance.
The same term nuisance is likewise by an extension
analogous to what the import of of which there the
are many examples in language language furnishes many examples applied to denote
the instrument itself by which the injury it produced,
the habit figure situation, motion or other qualities properties by which the instrument
