Inserenda. 55) Personal Inj:s
Nuisances. A Nuisance must be the using of one's own property
in such manner as to bring detriment on produce detriment to the
person or property of another: or at least if it be of
anothers property it comes under the notion of devastation.
A Nusance must be such an act as is detrimental to
a person while abiding in his own property land territory or
the common property territories of the community. If it is
on no other condition detrimental to a person than
on that of his coming on that land territories of him who is
the author of the nuisance it is generally speaking the fault of the
sufferer himself.
An exception however ought to be made in the case
of such parts of a man's territories, as it is customary
to suffer persons in general to travel over without
express consent. So with respect to dangerous
engines. engines inducing danger of acute pain.

Pidgeons. Pigeons to be kept so many for each acre cultivated
with such sorts of grain nam (enumerate them)

of a Dove house. These are purely real
nusances.
Hogs. Hogs n a Town if at all a nuisance, are more of a personal
than of a real nusance.
Pigeons. Game, viz: wild herbivorous animals are as much
nusances as Pigeons are
