5) Personal Violences. Simple.

Contumelious Assaults. Contumelious Assaults are to be treated of under
a separate head; because they do not of course
produce organical pain, and when they
do, they principal reason for punishing them
is founded not upon their producing that sort of pain, but
upon their producing another sort of Pain
altogether independent of hook or independing not upon of the former as it's
cause. This pain may be called the Pain
of Ignominy.

Venereal Offences violences A slight degree of organical pain may
also be a concomitant or an the accidental consequence of an
act the principal effect of which is (whether though
such be the design or not not the design) is to produce pains of
another nature: to wit, Pain of Ignominy,
and a Pain of [the Expectation Imagination]. Acts of this
description The acts I mean are those
which may come under the name of Venereal violences.
The motive to which them belongs not to other concupiscible
appetite like others to the co irrascible
appetite but to the Concupiscible.
Those also ought to be referred to a separate
head for the like reason.

Exemptive circumstances. Circumstances by which the act may be justified
may be: 1st Consent of the party whose person
