Other exemptive circumstances referred to the head of Disablement — why. with respect to organical pain, though they may
leave room not take away the reason there is for
wishing it not to have been produced, yet may
[make it not worth while] afford reason for not punishing
it the fact so much as without them it would be
proper to punish it, and may even make it not
worth while to punish it at all.

Disablement &c Mischief — The aestimation loose. The aestimation of the mischiefs of Disablement
Disfigurement and Mutilation are at best but
very loose guess work — For who shall prophesy
the several occasions of a mans life in which
such imperfections of shall be productive of procure him such
or such a kind of inconvenience to him and that
in point of intensity & duration to such and such amount?
