An attack. what. which it is has been the business of the present book to consider under
the name of personal Injuries.
Mischiefs of Defence less than those of attack Now of personal injuries the least slightest [in value] upon
an average is that kind which we have called by
the name of simple personal Injuries: Injuries
to wit that are productive of organical pain and
nothing more. If then the Pain of mischief of the an act of Disablement
appears to be less than the mischief of an act attack
like these of this least mischievous kind, of it
will appear a portion to be less than that of any an
act attack of any of the other kinds.
It does appear to be less for the following reasons
1st as between the aggressor and defender First when a man makes an attack upon another
in the design to do him a personal injury,
the length to which he means to carry his attack the injury
is always at first uncertain. The pain he is likely about
to produce is [indefinite] in [its] quantity indefinite
But the Pain of disablement is definite: and it
behoves to be less than that of the original attack.
For in general it may be said that Of the ordinary race of men there is no
man that hates another so much as he loves himself.
He will not submitt voluntarily to a greater pain, for
the pleasure of inflicting a lesser pain upon his
enemy. Note Japan Thus then the case stands between the aggressor
and the defender. The aggressor means to put
the defender to a certain degree of pain. The defender
means to put the aggressor to such a degree
of pain as shall be sufficient to make him desist
from such his purpose. Now according to the axiom abovementioned a less degree of pain is
