1st as between the aggressor and the defender. sufficient to make the aggressor desist from his purpose
than he what he meant to inflict on the defender.
Let therefore the aggressor and the defender each of them severally
inflict so much pain on the other as is necessary
for their respective purposes, the quantity of pain
produced by the defender acting up to his character
will be less in general than the quantity
of pain produced by the aggressor acting up to
his.

Thus stands the matter account of pain and pleasure
as between them two, the aggressor and the
defender, supposing no other persons interested in
the affair. But

2dly Still more when the public is consider'd Secondly There is a mischief of a public nature
consequent upon the aggressor's acting [carrying into
execution] effecting his purpose, which there is not upon
the defender's effecting his. Tis up the hands of
the defender, make no exemption in his favour,
and each every man will see who considers what has is done
will feel himself exposed without [remedy] defence to the attack of any every
one who has a quarrel with him: one of the two
great restraints being thus taken away by which men
are distur prevented from disturbing each other's peace.
to wit, restraint by the operation of the party, the
other being material by the operation of the Law.

[Restraint two fold] There are two kinds of restraint by which men are
in society are prevented from disturbing one another's
peace: restraint by operation of the party, and
restraint by operation of the Law. By the first alone in
