C Of Simple Personal Injuries.
A Simple Personal Injury what.
A Simple Personal Injury is where without lawful
cause (A) a man is concerned(B) in occasioning (C) bodily pain or uneasiness (D)
to another without occasioning or intending him any
farther (E) corporal mischief; or knowing him to be in immediate
danger (F) and being bound (G) to assist him forbears (H) giving
him assistance.
Exposition.
[(A) Lawful cause] See Tit. [Justifications] infra.
[(B) Concerned] See Tit. [Of Co-Offenders].
No matter by what means.
[(C) Occassioning] It matters not by what means the harm or
uneasiness be occasioned; whether by beating for instance or whipping
or wounding with or without an instrument; or by a Stream
of fire, water, air, or light; or by presenting a loathsome object
to the touch, taste, smell, hearing, or sight; by forcibly administering
a drug producing any bodily indisposition; by making
a dog or other animal serve as an instrument of mischief: Or
by false representations or other Artifice making an innocent person
or the party himself answer that purpose; for instance by
persuading him to walk into a snare, or to take an unwholesome
drug
