Of Personal Insults.
to gratify your passion, it is evident that it was in the way
of bodily pain that you meant to make him suffer: if only
by spitting in his face or by a slight kick, it is plain that
it was not in the way of bodily pain that you meant
he should suffer, but in the way of disgrace.
Justifications are
1. Consent. 2. Domestic power. 3. Military power. 4. Judicial
power. 5. Sovereign power.
Punishment.
Punishment. If any one offer to another a personal Insult, his punishment
may be as follows,
— 1. as for Simple Personal Injury 1. He may be punished as for a Simple Personal Injury.
Recantation 2. He may be made to ask pardon implore forgiving in a manner more or
less public and with ceremonies more or less humiliating.
3 Presence banishment. 3. In ordinary cases He may be banished from the presence of the party injured.
Aggravations. ConferConfer DefamationDefamation &and <add>Vituperation</add>
1. Presence of any Person. A personal insult offered to any one in the presence
of a third person is more injurious to him than when offered
to him when alone.
2. Party's dependence upon that Person . A personal insult that is offered to any person in the
