Self-tormenting &c
Whether it be worth while for a man to undergo the subject himself
mischief to the inconvenience of such an act for the sake of the benefit
every man is the best judge for himself: let him do
as he thinks fit. [If he is contented, it is well: the
public will at any rate be benefitted by the improvement
of his talent.]
Procuring Abortion The act of Procuring Abortion may be consider'd in a twofold
point of view: 1st as an operation dangerous to
the life and health and even the life of the patient:
2. as an act tending to diminish the force of the
community.
In the first point of view it does not seem to come
within the competency of the Legislator any more than
any other medical operation: it is for the patient herself
to choose between the risque and the advantage.
In the other point of view it will be considerd
under as an offence of the fourth class under the head of Offences
against the Public force
Where any person believing a drug or any
other medical application to have a tendency
to produce abortion persuades a woman to employ
it not apprising her of such consequence tendency, it is
a personal injury. See Pers Offences against
Individuals Title Personal Injuries.
