Offences against Condition Disturbance of Guardianship
Disturbance of Guardianship defined disturbance of Guardianship is where a person
without lawful cause(A) is concerned(B) in hinderingC the
Guardian () or the Ward of such or such a person from enjoying
the advantages() of their respective conditions.
Exposition
[(A) Lawful cause] See Justifications infra
[(B) Concerned] See Tit. [Co-Offenders.]
[(C) Hindering] It matters not by what means. See Tit. [Matrimonial
Disturbance] sub eadem vice.
[(D) Guardian] The act 1 The Father so long as he
lives is ordinarily the Guardian of his children during
their minority. But he may cease to be so in certain
cases specified by the Law. See Law of Parents and
Children, Law of Guardians and Wards. &c. &c.
2. Who is to be Guardian when the Father is
dead or has parted with the Guardianship, See in
the Law of Guardians and Wards
[(E) Advantages] To wit on the part of the Ward the advantage
of being under the care of a person whom the
Law has judged to be the fittest to take care of him: on
the part of the Guardian the satisfaction of enjoying
the company and contributing to the happiness and taking care of the present and future
ge happiness of a young person whom the Law
presumes to be dear to him.

Is the same as in case of Matrimonial Disturbance: which See
