2. In addition to the above mischief the subordination
necessary to the preservation of the peace of families
and the good education of young persons would be
destroy'd by intimacies of this kind subsisting between
young persons and their parents, or those who stand in the place
of parents to them: the daughter would acquire a preposterous
influence over her father, the son over his
mother, the sister over her elder brother. [Inexperience
& caprice would govern & domineer: maturity and experience
would truckle & obey.]
In some Catholic countries they punish under
the name of incest the offence of a Confessor who has
carnal knowledge of his penitent. It is very fit that
such an offence should be punished, but not under
the name of incest.
Punishments of an a very exemplary nature
such as those in which the offender is exhibited
with circumstances of infamy would aggravate
the shame & disgrace which an abomination contaminations of this sort [bring] reflect
upon the a family: banishment tends to lessen that
shame as much as possible by removing the guilty
person out of sight.
