I do not think it would possible to describe pitch upon any
other situation as an epoch which at the same time that it
might be described by general words, would be
capable like this of being depictured by some such material
representation as in every individual instance
of the act would come under the verbal description
The General Image I have all along born in mind
may be depictured in this the following manner
Fig 3d
Fig. 4
Suppose D.C. in the first Figure to be a body or
portion of space of any kind or figure
on whose upper surface another body
of any kind or figure B A is either at rest or
Now moving along in a direction different from that of
the line A.B. I say so long as a Man has gotten
it no farther down than the points C. as in Fig. 2d
or the point D. as in Fig. 3d or any other
point that can be assigned in the un-interrupted
line D.C. it is not taken — that is, not
till it is brought into the situation represented
in Fig. 4th.

THEFT - Note before the beginning of p.5.
Now the general Idea, exemplified in this this representation will may be transferred to & preserved
in any other individual instance of a taking
Be the body A B a handkerchief a part of a heap
of corn, a Cup, a Purse, or a part of a heap of corn & so on.
& be the body D.C. respectively a drawer in a Bureau, a Table, a
Pocket, or the remainder of the heap of corn & so on,
the touching surfaces being indefinitely during contact are variously diversified in figure
[which circumstance is abstracted in the picture in question]
in these & any
other number of
individual examples
that might be
assigned.
But the relation of place between the body moved &
that at rest being after the entire dissolution of contact
will I believe be found to be equally referable in every such example to the
general Idea
But now suppose it were the attempt that was to be
thus depictured — suppose in the instance of the cup
& there being 3 cups
The attempt is performed begun as soon as some overt act is
performed that can be referable to the intention
Suppose then 3 cups — The Malefactor takes up one himself,
bids his dog take up another, & sends a Porter
for the third.
The depicturable Images would be in every one of these cases
distinct & not characterizable by any common circumstance,
& that is not reducible to an uniformity by any course of abstraction:
In the first case the attempt would commence with he must be represented in the attitude of his grasping
at the Cup in the second in that of clapping of his hands or pointing with his hands
with emotion to the cup it, with his eyes fixed on the dog & his [+]
[+]
Mouth opining to speak with a countenance of gesticulation:
in the third without any gesticulation, in
that of barely opening his mouth to give directions
to the Messenger — Abstract what you will from
any of these images, you will never bring them
to any one depicturable point referable to the intention, in which they agree.
Bare contact of by any
part of his body indiscriminately
has no connection
with the intention
not even of by his
hands, the natural
organs of prehension
and yet a man
may take a thing
actively with others that
are not so, as his
mouth or feet,
or passively as it
were by suffering
a thing to fall into
a Basket hanging to
his back.
