of the Case before them were such as that the accused
could with any Degree of Reason be supposed to conceive
himself to have one — For this they need but to
consult their own Breasts; and if any one among
them putting himself in the Situation of the Criminal
could so conceive, it is not fitting the Man should suffer
as for a Theft: 1.st because the Act in Question
affords no Inference that he will be guilty of a
Theft in future : 2.dly because the Neighbourhood
much more the Community at large not understanding
it to be one, have no Apprehensions of him in
Consequence 3.dly because neither does his Acquittal
afford any Presumption of Impunity to those who
really are so

I must refer it once more to my the intelligent
Reader to decide for me, whether the Insertion of the
Word "Colour" is the more dangerous by its giving
Room for overscrupulous Acquittals, or it's Omission, for
over rigorous Convictions.

This Maxim, thus general and extensive,
should seem better calculated to keep Malefactors in
Aew than even a thorough Knowledge, were that
possible, of the whole Law relative to this Subject in
