1826. Octr. 25.
Review of Humphreys.

or 1.
Apt instrumentary
forms provided as to
delay and expence,
conveyance of immoveables
may be put on the
footing of do. of moveables.
Greater are neither difficulty
nor danger.

2.
Value equal, less danger
is there from misconveyance
of an immoveable than a moveable:
moveable may be
gone off with; immoveable,
not.

3.
If by superiority in value
were the cause
of demand for do. in
as evidenced
by formality, a thousand
pounds worth of diamonds
shd. require ten times
as much formality as
a hundred pounds worth
of land.

4.
1. Saving in delay.
Thus might be done
in a day, what now,
if done at all, takes
up years.

5.
Saving in expence
for nothing or next to
nothing what takes up
hundreds or thousands.

6.
Cause of the difference
as to formality: sinister
interest of the manufacturer's,
the Lawyers.

or 7.
The formalities applied
to immoveables would
have been applied to
moveables, were it not
that those non-lawyers
and with them lawyers
would have starved.
While the leaves were
being conveyed, all customers
were to have been
starving, and the first
batch the last.

or 8.
To all conveyances is
this improvement extendible.
1. To sales.
2 To Mortgages.
3. To Marriage settlement.
4. To leases.
5. To recovery of lease let
lands, or houses, or for
non-payment of rent, or
non-performance of contract.
6. To recovery of furnished
houses and lodgings for
non-payment of rent.

9.
With restitution power
in case of non-payment
even single Justices
may be entrusted with
less danger as to injustice
than is attached to
many a power they
have now.

10.
So, for breach of covenant
one Justice, or at any
rate, two,
especially if in the way
of appeal, right of, action,
with Jury trial, were saved.

or 11.
Being Landlords, those
Gentlemen and Noble
Lords should not naturally
be averse to
this.

or 12.
Damage as to injustice
much less here
than in case of distress
for rent, where
the Landlord is made
Judge, and decrees and
makes application of
the satisfactive remedy
given to him by the law.
