Art 5. Trusts.
In either case, the word use is a
mere nuisance: it affords, as by the inventor
it was designed to afford, a pretext for throwing
every thing into confusion, and making
the Estate to some purposes the ice party's
Estate, to other purposes the others; and thus
tossing it backwards and forwards between
one set of Lawyers and another like a ball or shuttlecock,
with no small portion of the substance
of it at every stroke sticking to this fingers.
This distinction, as above observed,
extends ever the whole field of law: the conjugal
power excepted, scarcely in any shape can power
be conferred upon a party, to be exercised for
his own benefit, in the instance of which the
same power may not with use and propriety
be conferred for the purpose of its being exercised
for the pure benefit of another. Not that
the converse of this holds good: for extensive
is the class of powers which can not, with the
beneficial effect upon the whole, be exercised
for the pure benefit of the party, on whom
they are conferred: witness public trusts in
general:— powers exercised by the functionaries
belonging to the several departments of Government,
the Legislation, the administrative
and the Judiciary.
