Review of Sugden

Hitherto I have said judge made law; but this appellative
favorable as it is is still too favorable. Taken in the
strict sense judge made law would be the work either of
a monarchy or an oligarchy, according to the judicatory.
But in fact at the far greatest part of it has been the
work of three estates: Judge or judges, one; Notetaker, two;
Publishing bookseller three: any one of the three judicatories
failing either the bill is not brought in or if brought in it
is lost: Unless a note taker is present and at his work, the
wisdom of the Judge is lost, charm he never so wisely:
unless the fruit of the note taker's labor presents itself to
the eye of the bookseller in an acceptable shape the
fruit howsoever fair and brought to maturity is in this
last stage left to wither on the shelf. A natural and who
can say how frequent the consequence is that many a
dictum which now makes Law and determines the
fate of all who come within the reach of the Scepter
has been the offspring of the brain not of the high seated
and well farmed sage but of the uncommissioned individual
with or without his gown of stuff: and thus in
many an instance, spurious or genuine is a question
beyond the reach of determination
