J.B. v. Sugden 10 Dec. 1826

What Mr S. insists on is that all law should be made by
a set of men who by their own confession have no authority to make
laws: who when made after these measures, have then to
find their way in the world, never put any information
when, where, by whom they were made, at what shop they
are to be bought. not so much as by what assemblage
of words they are expressed. Good reason why no such
words have they belonging to them. of in

The grand and comprehensive object of his endeavour is
The great necessity is to prevent any thing from
being foreseen and provided for by Statute law; and to what
end? Pray that it may be left to be provided for by Common
Law what is effectively and inevitably incapable of making
provision for any thing: a pharmacopoeia from which all
remedies of the preventive kind are excluded: and which
by which no evil in any shape can be obviated till after
or an instance of it has taken place: the system of
economy which forbids the shutting the of any stable door
till after at least one horse has here stolen out of it.
