As to the cause of the evil in its present state the
whole of it has one perfectly simple and to all eyes that
can endure to look at it manifest cause — particular and
sinister interest in the breasts of its upholders: applied
to ancient and modern times together the two periods
will require for the indication of the cause two distinguishable
denominations: causes of the creation of it
sinister interest coupled with the ignorance and horror
the results of inexperience causes of the preservation of
it in modern times the same sinister interest coupled
with its progeny interest begotten prejudice and authority
begotten prejudice. As to the remedy that which would
be suggested and the only one that could be suggested
by these causes if admitted would be the complete abolition of the
existing system and a substitution of an entire new
one of a character directly opposite for in any system
established on this or any other part of the field of law
what should be throughout the ends in view what
but the giving execution and effect to the whole substantive
branch of the law by the avoidance of misdecision
and nondescision and by exclusion put upon all
needless and avoidable delay vexation and expense
what on the other hand is the system pro character
of the system produced — the only system that
could have been produced by a particular and sinister
interest in the breasts of the author what but
maximization of misdecision and nondecision, for
the sake of the power and of delay vexation and
expense for the sake of the profit derivable out of the expense
