1826. Decr 12
J. B. v. Sugden
1.
Per S. simplifications
cod be evaded.
p. 23 "The proposed rule is opposed to the habits and
genius of the nation, and would if enacted be immediately
evaded."
Suited to the habits of the nation indeed!
say rather to the habits of the conveyancers. And What
does the nations know about conveyancers? What
part of the nation draws it's own conveyances? And
whence came the habits of conveyancers? But
he interests the sinister interests of those conveyancers?
And these same conveyancers who are they? Either
practising Barristers or Attornies, or men united to
both tribes by a community of sinister interest.
They would be evaded, would they?
A good round assertion this: and the assertion does
he or does he not believe it to be true? If not then
what are we to think of Learnedassertion? For,
not being feed for uttering falsehood, no justification
can he plead for uttering them. In the other case,
what are we to think of the opinion entertained by
him — in the first place of these same judges, in
the next place of the Legislature. To meet the Mandates
the known will of the Legislature — is the desire
and endeavour of these same judges. It will moreover
be in their power, for the effect will be produced.
And
p. 22. "but all remainders and other dispositions expectant,
or to take place after the absolute of any such
preceding limitations, or beyond the period within which
the same are confined, or upon any event more remote
than what the preceding rule authorizes, are made utterly
avoid."
