1. Case.
VIII. Blind fixation

1. Explanation
VIII. Device 8th Blind
fixation of times for performance
of Judicial
operations.
Example. Attendance of
suitors as witnesses at
the judgment seat.

2. Explanation
Attendant suppose at
commencement the
proposed pursuer: necessary
exceptions excepted.
Suit not discussed,
day for first continuance
will be to be named:
say such a day thereafter.

3. Explanation
By existing system
blind fixation principle
some one day for first
continuance, and so on, as
applied in all cases.

4. Explanation
No Reckoning from the
first attendance day
there can not be: there be:
there being as such
day. Till the day for determination,
his Lordship
is never at home.

5. Explanation
At the Judge's shop, a
plaintiff must buy a
mass of absurdity, called
a writ, served out, and
no questions asked.
Defendant, on seeing done
at his charge what the
Plaintiff demands, must
employ another Attorney
to give a correspondent
answer to it, and so on.

6. Proper Course
Witnesses and Co-pursuers
as it may happen,
necessary at any
rate will be a day for
attendance of Defendant.

7. Mischief Absurdities Attendance
But of his abode, the
distance from the Judgment
seat may be a
stone's throw, or 300
miles.
Yet by Judge & Co. the
same day has been appointed for all distances.

8. Absurdities Attendance
For simple attendance,
comparatively short
may be the interval
appointed.

9. Absurdity Pleading
Not so, where the operation
to be performed
is the drawing up and
delivering in a written
instrument, a pleading
as per device II. Varied
indefinitely will be the
time requisite by the
quantity of writing and
various other circumstances
– Notice sufficient
may be afforded
by one day's interval
not by two months.
As infinity to one the
chances in each case
against the propriety
of the day appointed
for all cases.
