Petition for Justice.

1. Case
VIII. Blind Fixation

Note on the word proposed. Supposing
the ends of justice the ends aimed at. Note on this occasion
the indispensable need of it, in addition to the
several terms plaintiff or pursuer and defendant.
Under the existing system, no such distinction has place.
How so? Answer. Because, as to the plaintiff's side,
without need of special allowance from the Judge,

To act in this character is every man that
pleased. Be they who they may, and in what number
they may, every man whose wish it is to torment,
and wherever there is not money enough for
going on with the defence, to ruin any other man or
any number of men, is received with open arms:
the price for the writ being paid, and in this same
way, each succeeding operation performed and instrument
delivered in, the whole process goes on of course:
every person who proposes himself for plaintiff is received
as such, as a customer is at any other shop-
no questions asked; and thus is made to evaporate the
distinction between actual and proposed plaintiff.

On the other hand, every man in relation
to whom any other man, by so becoming plaintiff, has
required that he should be put to the alternative
of either rendering the service demanded by the said
plaintiff at his charge, or by contesting the plaintiffs
right to such service so demanded, act in the character
of Defendant, is forced either to act in that
character, or submit to the burthen, whatever it be,
thus sought to be imposed upon him: and thus
is made to evaporate the distinction between actual
and proposed Defendant.
