Petition for Justice
Result to the production of which they are in appearance
directed, compliance: result, to the production
of which they were in reality directed, non-compliance:
for, from compliance, are received
either no fees at all, or fees to no more than a
comparatively smaller amount: from non-compliance,
showers of fees.
Now as to the persons of all descriptions
put together, on whose part attendance at the judgment
seat may happen to be necessary: extraneous witnesses,
co-defendants and co-pursuers. Mark now
the course which, in regard to the end in view,
could not have failed to prescribe. On hearing that
which, on his first appearance, the applicant plaintiff
had been saying in relation to his demand, "Come
hither again" (the Judge would say, unless he dismissed
the suit,) "come hither again on such a day",
mentioning it. On hearing at the same time what by
that same plaintiff had been said in relation to the
proposed Defendant, as to where he is or is likely to
be found, and what is the earliest day on which,
after a summons had reached him, with sufficient
interval for preparation, he would probably be able to
pay attendance, he, (the Judge) would accordingly cause
to be transmitted to the proposed Defendant a mandate,
naming a day for his attendance – So likewise as to
any other person at whose hands testimony afforded an
adequate promise of, being desirable and obtainable,
naming either for each one his own earliest day, as
above, or for several or all, one and the same day:
according as mutual confrontation afforded or not
an adequate promise of being instructive.
and so in regard to Co-defendants, where
the suit afforded any and Co-plaintiffs.
