§.3. Suits in pendency
Lawyers indemnity
From the full amount in every case some
deduction nor that an inconsiderable one will not
be thought unreasonable consideration had of the
total cessation of that labour which is at present
so intense and that running to a great degree in
proportion to the quantity of the emolument.
Fifty per cent under the name of half pay is
the amount of the deduction at present in very
extensive use for example in both branches
of the defensive force establishment. In the present
instance however the application of this
principle would seem to present a demand for
some modifications. First in the instance of the
inferiors in age and quantity of business taken
together neither the half pay nor even the whole
pay could it should seem be re reasonably stated as
sufficient for here in comparison of future prospects
present income would be in a greater or less degree
inconsiderable and upon these future prospects in
all their gradations the extinguisher would be dropped.
Power should be given in these instances for extinguishing
the pension of retreat who by location of the pensioner
in a situation of active service.

in the profession and for whom no provision on this
score would be to be made.
