Supplement
10 §.3 Suits in pendency

22
But to whom shall
this power be given
To a
thereupon a horse laugh
at the ridiculousness

But here comes a question — A trust of such magnitude!
to whom shall it be confided? A Chancellor? no more than a
greater man than a Chancellor will be every individual till when this person is confidate
Thereupon either a horse laugh upon paper viva voce or on
paper at the ridiculousness of the idea of conferring a power of
such a magnitude in A.R. v C. or State is
Then for what purpose allowance will be made to this or that lawyer
in what instance alledged inaptitude may have been most
notorious

23
But suppose two
arbiters appointed

two parties very
unequal in aptitude

Answer. Instead of even one single one suppose the pair
equal to hundred times than of any Chancellor: and on the other
part the inaptitude as great as is the po whole population of W.
But would be to be found. Under both these suppositions no
greater could be the evil than what that already brought to
view as above.

24
To whom shall the
locative function
be assigned to Choice
or to Chance

To which of two arbiters shall the locative function be
assigned? to Choice or to Chance? To Choice more common
usage: but th on the part of Chance the disused would
not be altogether an unbearable one, and now admitting this
to be the least apt of the two still no greater evil could ensue be the result
than as above.

Now suppose Chance the allegorical personage to whom
the function was committed. Here would be so much patronage.
Patron for the whole the most obvious the Chancellor. But suppose the Officer Secretary
to put in for a share. Fight dog! fight bar! might
be the vision of any person, to whose bulk in whose instance of their particular
lay alike objects of indifference, the sole object of regard,
are the ends of justice.
